Family Law in Cherry Hills Village

In Colorado’s wealthiest municipality, the support formulas that decide most divorces run out before they reach the median household. What replaces them is argument, valuation, and preparation.

Cherry Hills Village is a community of roughly 6,400 people on some of the largest residential lots in the metro: the city's own zoning code runs up to a two and a half acre minimum in its R-1 district and still regulates the keeping of horses. The Census Bureau cannot report the Village's median household income or median home value precisely, because both sit at or above the ceilings the Bureau publishes. That is not trivia. It is the single most important fact about divorce here, because Colorado's support guidelines are built for households the formulas can see.

Fortress Family Law handles Cherry Hills Village matters in the courthouse that hears them, the Arapahoe County District Court. The numbers below show exactly where the guideline math stops for a household at the Village's income level, and what that means for how a case has to be prepared.

Where a Cherry Hills Village divorce is filed

Cherry Hills Village sits in Arapahoe County, and since January 2025 the 18th Judicial District covers Arapahoe County alone. Domestic relations cases are heard at the Arapahoe County Justice Center, 7325 South Potomac Street in Centennial, about a fifteen minute drive from the Village.

Colorado runs two separate 91 day clocks: one spouse must have been domiciled in the state for 91 days before filing under C.R.S. 14-10-106, and no decree can enter until 91 days after the other spouse is served or joins the case. Venue follows Rule 98(c) of the Colorado Rules of Civil Procedure, which in practice puts Village cases in Arapahoe County. When children are involved, Arapahoe County courts routinely order both parents to complete a court approved parenting education class under C.R.S. 14-10-123.7 and file the certificate.

The guideline math at Cherry Hills Village's median income

Colorado's support formulas are built for households the Census can measure, and Cherry Hills Village is not one of them. The illustrative facts: a 18 year marriage, a 80/20 earning split of Cherry Hills Village's median household income of $250,001 or more, two children, and 200 overnights a year with the lower earning parent.

Above the formulacombined income exceeds the $240,000 a year advisory cap
$1,245/moguideline child support, paid by the higher earner

Read that first figure carefully. The advisory maintenance formula in C.R.S. 14-10-114 stops at $240,000 of combined annual income, and the Census ceiling for the Village's median household sits above $250,000. At the Village's income level, maintenance is not a formula result. It is an argument about lifestyle, earning capacity, and the factors the statute lists, made to a judge who has discretion.

Both figures come from the engines behind our free maintenance and child support calculators. They are illustrations, not predictions (how these examples are computed). For the full walkthrough of the 2026 child support law, read our attorneys' worked examples.

What is actually on the table in a Village divorce

The marital estate in Cherry Hills Village rarely looks like a house and two retirement accounts. It looks like an estate property on acreage, sometimes with water or equestrian improvements, membership interests in clubs like Cherry Hills Country Club, the course that hosted the 1960 U.S. Open, or Glenmoor Country Club on Glenmoor Drive, closely held business interests, and deferred or concentrated compensation. Colorado divides marital property equitably, not equally, under C.R.S. 14-10-113, and equitable division of illiquid assets is a valuation fight before it is a division fight.

Club memberships deserve their own sentence, because families are often surprised: whether a membership has divisible value, whether it can be transferred at all, and what the club's own bylaws say about divorce are three different questions, and the answers vary club by club.

Privacy is the other Village-specific concern. Financial disclosures in a dissolution are detailed, and for households with visible names or businesses, protective orders limiting who sees what, and how filings are handled, are a routine part of doing this well.

Schools, parenting time, and the private school question

Two of the metro's most prominent private schools sit inside the Village itself: Kent Denver School on its 200 acre campus at East Quincy Avenue, and St. Mary's Academy on South University Boulevard. For public school families, most of the Village lies within the Cherry Creek School District, though not all of it, so the assigned school depends on the address, which matters when parents will keep two households.

Private school tuition is not automatically part of child support. Colorado treats it as a possible adjustment under C.R.S. 14-10-115 for extraordinary educational expenses, which means it gets negotiated or argued. If your children are at Kent Denver or St. Mary's, that line item can exceed the entire guideline support amount, and our child support calculator handles it as the statute does.

Above the guidelines: how high income cases are actually decided

Two ceilings matter here. Maintenance guidance ends at $240,000 of combined annual income. The child support schedule now extends to $40,000 of combined monthly income, higher than before the 2026 amendments, but above it the statute sets a floor and leaves the rest to discretion. Between those lines, outcomes are driven by the statutory factors: the marital lifestyle, each spouse's earning capacity and separate estate, the length of the marriage, and the children's reasonable needs in context.

That is the honest reason preparation matters more in Cherry Hills Village than almost anywhere else in the state. When the formula decides, lawyers check arithmetic. When discretion decides, the record you build is the outcome.

And one thing said plainly to the spouse who did not earn the money: Colorado does not leave you to face this outgunned. Marital property divides equitably regardless of whose name earned it, and under C.R.S. 14-10-119 courts can order the monied spouse to fund both sides' counsel, so the case is decided on the facts rather than the war chests.

Questions we hear

Cherry Hills Village family law FAQ

Can we resolve this without ever standing in a courtroom?

Often, yes. High asset cases settle when both sides have priced the alternatives honestly, and mediation with an experienced neutral resolves many Village matters privately. The court still reviews and enters the final orders, but your finances need not be argued in an open courtroom to get there.

If the formula does not decide our maintenance, what does?

Evidence. Above the guideline range the court weighs the statutory factors: the marital lifestyle, each spouse’s earning capacity and separate estate, the length of the marriage, and reasonable needs in context. Those are proved, not asserted, which is why financial presentation and expert work decide these cases.

How is our home on acreage divided?

Colorado divides marital property equitably under C.R.S. 14-10-113. For estate properties that usually starts with competing appraisals, and improvements like barns, water features, or equestrian facilities can put real distance between them. Who keeps the property, and what offsets that, is negotiated against the whole estate.

Is a country club membership marital property?

It depends on the club. Some memberships hold transferable value, some are personal and non-transferable, and most clubs have bylaws that speak to divorce directly. We read the membership documents before anyone takes a position on value.

Can we keep the details of our finances out of the public file?

Financial disclosures are mandatory, but courts can enter protective orders limiting access, and counsel can structure filings so sensitive schedules are not sitting in the open file. If privacy matters to your family, raise it at the first consultation, not after documents are filed.
