Family Law in Golden

A city of about 20,000 people hosts the entire family law docket for Colorado’s second most populous county. It also has a second courthouse that cannot touch your case.

Golden has been the seat of Jefferson County since the territorial era, and it kept that role even after losing the territorial capital to Denver in 1867. The result is unusual: every divorce, parenting case, and protection order in a county of nearly 590,000 people routes through a city of roughly 20,000.

That also creates the most common practical mistake here. Golden has two courthouses, both with a Golden address, and they do entirely different work.

Two courthouses, and only one hears family cases

Family cases go to the Jefferson County Courts inside the Jefferson County Government Center at 100 Jefferson County Parkway. Despite the Golden address, the campus sits about two and a half miles from the historic downtown, off the parkway rather than on Washington Avenue.

The Golden Municipal Court is a different building entirely, in City Hall at 911 10th Street downtown, and its jurisdiction covers traffic and Golden municipal code violations. It cannot hear a divorce, a parenting case, a support matter, or a civil protection order. People arrive at the wrong one often enough that it is worth saying plainly.

Jefferson County shares the 1st Judicial District with Gilpin County. The statewide requirements apply here as everywhere: 91 days of Colorado domicile before filing under C.R.S. 14-10-106, a further 91 days after service before a decree, venue under C.R.C.P. 98(c), and a parenting class routinely ordered for parents of minor children under C.R.S. 14-10-123.7. For anyone traveling in, the W Line's western terminus is the Jefferson County Government Center station, roughly forty minutes from Denver Union Station.

The guideline math at Golden's median income

Short marriages produce short maintenance terms, and the arithmetic shows exactly how short. The illustrative facts: a 5 year marriage, a 68/32 earning split of Golden's median household income of $98,582, two children, and 245 overnights a year with the lower earning parent.

$526/moadvisory maintenance guideline, 21 month term
$850/moguideline child support, paid by the higher earner

Notice how short that maintenance term is. Colorado's advisory guidelines scale duration to the length of the marriage, so a five year marriage produces a term measured in months rather than years, while the child support obligation is driven by incomes and the parenting schedule instead. Two families with identical incomes and very different marriage lengths get very different answers.

Both figures come from the engines behind our free maintenance and child support calculators. They are illustrations, not predictions (how these examples are computed). For the full walkthrough of the 2026 child support law, read our attorneys' worked examples.

PERA accounts and the local employers

Golden's two anchor employers give its divorces a distinct financial shape. Colorado School of Mines is a state institution with about 8,200 students, which means employees there participate in Colorado PERA rather than Social Security. PERA accounts do not divide through an ordinary qualified domestic relations order. Colorado has its own written agreement process for dividing them, and using the wrong instrument means the division does not happen.

The Coors brewery, now part of Molson Coors, remains the largest single-site brewery in the world and employs roughly 900 full-time workers in town. Long tenure at either employer tends to mean a substantial retirement interest built during the marriage, which is marital property to the extent it was earned there.

Housing in Golden runs from historic downtown properties to newer construction on the mesas, and separate property questions come up often where a home predates the marriage. The property may stay separate while the increase in its value during the marriage is marital, and those are two different numbers.

Schools and the school year

Golden students attend Jeffco Public Schools, Colorado's second largest district, which runs a choice enrollment process with a first round decided in January and later rounds through the summer. A parenting plan drafted in the spring can arrive after the round that determines the fall assignment, so the plan should name who applies and by when.

With Colorado School of Mines in town, Golden also has a meaningful population of student and academic families whose schedules run on an academic calendar rather than a standard work year. Parenting plans built on semesters and academic breaks hold up better here than ones built on a generic template.

Questions we hear

Golden family law FAQ

Which Golden courthouse handles my divorce?

The Jefferson County Courts at 100 Jefferson County Parkway, in the Jefferson County Government Center. Not the Golden Municipal Court at City Hall on 10th Street, which handles only traffic and city code matters. Both carry Golden addresses, which is exactly why people end up in the wrong lobby.

Is the courthouse in downtown Golden?

No, and it is worth planning for. The county campus sits about two and a half miles from the historic downtown along Jefferson County Parkway. If you are relying on transit, the W Line ends at the Jefferson County Government Center station, which serves it directly.

How is a PERA retirement account divided?

Through Colorado’s own written agreement process for dividing PERA accounts, not through a standard qualified domestic relations order. Employees of state institutions, including Colorado School of Mines, are typically in PERA rather than Social Security, which makes the retirement interest a larger share of the marital estate than people expect.

We have only been married a few years. Does maintenance still apply?

The advisory guideline formula applies to marriages of at least three years, and the suggested duration scales with the length of the marriage, so shorter marriages produce shorter terms. Whether maintenance is ordered at all still depends on need and the statutory factors, and short-marriage cases often resolve without it.

Does Jefferson County cover more than Jefferson County?

The 1st Judicial District includes Gilpin County alongside Jefferson, with courthouses in Golden and Black Hawk. Your case follows your county of residence, so Golden residents are heard in Golden.

These answers are general information about Colorado law, not legal advice about your situation. For advice you can rely on, talk with an attorney about the specifics of your case.
